These End User Purchase Terms and Conditions are in addition to and subject to the Terms of Use for the SModcastle Cinemas ("Cinema" or "Theater") Website (the "Website") and the services provided through the Website (the "Website Services"). Cinema Hosting ("CH") is the website service provider working with the Theater. All customers who attempt to buy or reserve a ticket or who actually buy or reserve a ticket ("Attendee") using the Website or Website Service agree to these Purchase Terms and Conditions by accessing or using the Website or Website Services. Our privacy policies and Terms of Use are incorporated herein by reference.
Must be 17 years old or older to make a purchase through this site. By initiating or completing a purchase through this site you are representing that you are 17 years old or older and the information you are entering on this site is that of someone who is 17 years old or older. Each ticket the Attendee purchase is for the purpose of gaining entrance to a particular event at the Theater that is separate from CH. CH is not responsible for anything that may occur or happen at a Theater. The Attendee may also be subject to additional terms and conditions required by each particular Theater and each Attendee should request, locate and familiarize themselves with the policies of any Theater at which they may attend an event or performance.
Who You Are Buying From
CH acts as the software by which the Theater is able to sell tickets for events to an Attendee. CH is not the offeror or seller of any tickets for any event to the Attendee. All communication regarding the purchase or attempted purchase of a ticket should be between the Attendee and Theater.
Pricing and Availability
CH does not control the inventory or the ticket availability for any event. The prices for each ticket and event are set solely by the Theater.
Currency
All ticket prices for events that occur in the United States are stated in U.S. Dollars. All ticket prices for events that occur in Canada are stated in Canadian Dollars.
Payment Methods
The accepted payment methods differ at each Theater and the methods which are available is at the sole discretion of the Theater. All Theaters accept both Visa and MasterCard. Optionally, a Theater may choose to also offer Discover, American Express, Apple Pay, Google Pay, and Diner's Club.
Credit card information is not stored within the CH system.
Convenience Charges & Order Processing Fees
Tickets purchased through CH can be subject to a per ticket convenience charge and/or a per order processing fee. Convenience charges and processing fees for an online order are non-refundable to help the Theater cover credit card and system fees.
Amount of Tickets Per Attendee
When purchasing tickets through a CH website, Attendee may be limited to a specified number of tickets per transaction. If a maximum amount exists, it is posted during the purchase process and is verified with each transaction. This policy is in effect to discourage unfair ticket buying practices and to expedite the time it takes to process an order.
Billing Information Verification
Orders are processed when "Submit Payment" is clicked at which time, the billing information is also verified. Occasionally, incorrect billing or credit card information will cause an order to be declined. In these cases, Attendee should verify the billing information with the credit card issuing company or bank before making another purchase attempt.
Declined Transactions
In the case that the Attendee attempts to purchase tickets to an event and the transaction is declined, Attendee will see a message on the screen stating the declined reason. When a transaction is declined, it can appear on Attendee's online bank statement as "pending". These declined transactions will be removed from Attendee's online banking statement within 7 days.
Order Confirmation
If Attendee does not reach the Order Confirmation page or receive the confirmation email after submitting payment information, or if an error message appears after submitting payment information, it is the responsibility of the Attendee to confirm with the Theater whether or not the order has been placed. The Theater may not automatically be made aware of any problems that occur during the purchase process. CH is not responsible for losses (monetary or otherwise) for errors that occur in the ticket purchase processing and or confirmation process, including, without limitation, if Attendee assumes that an order was not placed due to not receiving the confirmation.
Refunds and Exchanges
No refunds will be offered for live / special events. Before purchasing tickets, carefully review your event and seat/ticket choices.
Regularly scheduled movie ticket purchases may be eligible for refunds. You may attempt to contact the Theater directly to request a refund. Any refund issued by the Theater is at the discretion of the Theater and subject to their refund policy. The Theater may elect to withhold Service Fees from a refund to cover fees incurred from the transaction.
CH acts as an agent for the Theater and policies set forth by the Theater generally prohibit CH from issuing exchanges or refunds after a ticket has been purchased. You agree that you will not attempt to evade, avoid, or circumvent those prohibitions in any manner with regard to tickets you purchased. Without limiting the generality of the foregoing, you will not contact CH to seek a refund from CH when CH is prohibited from providing one by its clients, and you will not dispute or otherwise seek a "chargeback" from the company whose credit card you used to purchase tickets from CH. Should you do so, your tickets may be canceled, and CH may, in its sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using CH.
Canceled and Postponed Events
Occasionally, events are canceled or postponed by the Theater. Should this occur, the Theater is responsible for contacting the Attendee regarding rescheduling, refund or exchange procedures for that event. The event information online or the confirmation email sent by the Theater may contain instructions regarding canceled or postponed events. If an event is canceled, please contact the Theater for further information. In no event will CH in any way be responsible for any refund or reissuing of tickets for cancelled, postponed or rescheduled events.
Limitation of Liability
Attendee assumes all risks incidental to the event for which a ticket is issued, whether before, during or after a performance, and waives any claims for personal injury or death against CH on behalf of Attendee, any accompanying minor and their successors, assigns, heirs or estate.
